Sir,
: I am directed to refer to your latter dated 13th August 1969, on the subject noted above, and to state that Government considers: that the dispute between the two sects of Jains been finally settled by the decisions of the judicial Commissioner, Central Provinces, in 1923 and the Privy Council in 1929, and the High Court, Nagpur Branch in its judgement dated 6th April, 1966, in civil Revision Application No. 351 of 1964, having held that these decisions would stand until they are set aside in accordance with law, the rights accruing to the two sects in accordance with these decisions should be upheld and protection afforded for enforcing the rights and preventing any thing being done contrary to these rights. Government is of the view that the rights of the respective sects should be upheld and steps taken to uphold the said rights till the decisions are modified in due course of law, the District Magistrate, Akola, has been: asked to take action accordingly.

મહરાષ્ટ્ર રાજ્યના ગૃહ ખાતા સાથે આ અંગે ઘણું જ લાંબે પત્રવ્યવહાર. થયેલ છે. અને શેઠ શ્રી કસ્તુરભાઈના પ્રયત્ન અને આપણું સત્ય હકીક્તની રજુઆતના કારણે ઉપર મુજબને તા. ૧૮-૧૦-૬૯ને મહારાષ્ટ્ર સરકારના ગૃહ વિભાગને પત્ર મળે છે, જેમાં જણાવેલું છે કે, “તેઓ તાંબરેને પ્રિવ્હી. કાઉન્સીલ તથા અન્ય કેટેના ચુકાદાઓથી મળેલા હક્કો માન્ય રાખે છે. અને એમ માને છે કે તાંબરે વચ્ચેના ઝઘડાઓને આ રીતે તે ચુકાદાઓથી અંત આવેલ છે. અને તે હક્કો જ્યાં સુધી માત ફેરવાયા નથી ત્યાં સુધી બરાબર અમલમાં આવવા જ જોઈએ અને તે અમલમાં મુકવા માટે સરકારે સંરક્ષણ આપવું જોઈએ. અને આ હક્કોથી વિપરીત કાંઈ પણ ન થવું જોઈએ. તે જોવાની સૂચને અકેલાના જિલ્લા મેજેસ્ટેટને આપવામાં આવી છે.”
