શ્રી અ`તરિક્ષ
(A) સન ૧૯૦૫ માં થયેલા ટાઇમ-ટેબલની ગોઠવણ પ્રમાણે દિગંબરાને પણ તેમના સમય દરમિયાન ચક્ષુ ટીકા-મુગટ અથવા આભૂષણેાથી રહિત મૂર્તિની પૂજા કરવાનો અધિકાર છે. માત્ર તેમણે કચ્છાટ, કટિસૂત્ર તથા લેપને ન ખસેડવાં કે તે સ ંબંધમાં માથું મારવું નહીં.
આ ચૂકાદાથી શ્વેતાંબરેશને અમુક પ્રકારના સંતાષ થયે, પણ દિગંબરા ઘણા જ નારાજ થયા તેથી તેમણે ઇંગ્લાંડમાંની પ્રીવી કાઉન્સીલમાં અપીલ કરી. આ અપીલને ચૂકાદો સન ૧૯૨૯ ના જુલાઇની ૯ મી તારીખે આવ્યે. પ્રીવી કાઉન્સીલે નાગપુર કોર્ટના ચૂકાદાને જ માન્ય રાખ્યું અને દિગબરની અપીલ કાઢી નાખી. તેમજ નાગપુરની કોર્ટમાં શ્વેતાંખીને જે ખર્ચ લાગ્યા હતા તે ખર્ચ અને પ્રીવી કાઉન્સીલમાં કેસ ચાલ્ય તે દરમ્યાન ઇંગ્લાંડમાં શ્વેતાંબરાને થયેલા ૬૮૯ પાઉન્ડ( લગભગ દશ હજાર રૂપિયા)ના ખર્ચે દિગ...ખરીએ શ્વેતાંબરાને આપવા એ જાતને પણ પ્રીવી કાઉન્સીલે હુકમ કર્યો.
Their Lordships do this day agree humbly to report to Your Majesty as their opinion that this appeal ought to be dismissed and the decree of the Court of the Judicial Commissioner of the Central Provinces dated the Ist day of October 1923 affir med and that the petition for stay of execution ought to be dismissed.
And in case Your Majesty should be pleased to approve of this report then Their Lordships do direct that their be paid by the Appellants to the Respondants their costs of this appeal incurred in
