336] [व्यवहारसूत्र सूत्र 3.4 5-6 7-8 कम से कम तीन वर्ष की दीक्षापर्याय वाला भिक्षु आचारसम्पन्न, बुद्धिसम्पन्न, विचक्षण, बहुश्रुत, जिन-प्रवचन की प्रभावना में दक्ष तथा कम से कम आचारांग एवं निशोथसूत्र को अर्थ सहित धारण करने वाला हो, उसे उपाध्याय पद पर नियुक्त किया जा सकता है। जो भिक्षु तीन वर्ष की दीक्षा पर्याय वाला हो, किन्तु उक्त गुणसम्पन्न न हो तो उसे उपाध्याय पद पर नियुक्त नहीं किया जा सकता। उपाध्याय के योग्य गुणों के सिवाय यदि दीक्षापर्याय पांच वर्ष और अर्थसहित कण्ठस्थ श्रुत में कम से कम आचारांग, सूत्रकृतांग और चार छेदसूत्र हों तो उसे प्राचार्य पद पर नियुक्त किया जा सकता है तथा वे पाठ संपदा आदि से सम्पन्न भी होने चाहिए। पांच वर्ष की दीक्षापर्याय वाला भिक्षु उक्त गुणों से सम्पन्न न हो तो उसे प्राचार्य पद पर नियुक्त नहीं किया जा सकता है। उपर्युक्त गुणसम्पन्न एवं कम से कम आठ वर्ष की दीक्षापर्याय वाला तथा पूर्वोक्त आगमों सहित ठाणांग-समवायांगसूत्र को कण्ठस्थ धारण करने वाला भिक्षु गणावच्छेदक पद पर नियुक्त किया जा सकता है / आठ वर्ष की दीक्षापर्याय वाला उक्त गुणसम्पन्न न हो तो उसे गणावच्छेदक पद पर नियुक्त नहीं किया जा सकता है / किसी विशेष परिस्थिति में अन्य गुणों से सम्पन्न योग्य भिक्ष हो तो उसे आवश्यक दीक्षापर्याय और श्रुत कंठस्थ न हो तो भी प्राचार्य उपाध्याय पद पर नियुक्त किया जा सकता है / गच्छ में अन्य किसी भिक्षु के योग्य न होने पर एवं अत्यन्त प्रावश्यक हो जाने पर ही यह विधान समझना चाहिए / इस विधान से 'नवदीक्षित' भिक्षु को उसी दिन आचार्य बनाया जा सकता है। चासीस वर्ष की उम्र से कम उम्र वाले एवं तीन वर्ष की दीक्षापर्याय से कम संयम वाले साधु-साध्वियों को प्राचार्य उपाध्याय की निश्रा बिना स्वतन्त्र विचरण करना या रहना नहीं कल्पता है तथा इन साधुओं को प्राचार्य और उपाध्याय से रहित गच्छ में नहीं रहना चाहिए और साध्वियों को प्राचार्य उपाध्याय एवं प्रतिनी इन तीन से रहित गच्छ में नहीं रहना चाहिए। इनमें से किसी के कालधर्म प्राप्त हो जाने पर भी उस पद पर अन्य को नियुक्त करना आवश्यक है। आचार्यादि पद पर नियुक्त भिक्षु का चतुर्थ व्रत भंग हो जाए तो उसे आजीवन सभी पद के अयोग्य घोषित कर दिया जाता है। पद त्याग करके चतुर्थ व्रत भंग करने पर या सामान्य भिक्षु के द्वारा चतुर्थ व्रत भंग करने पर वह तीन वर्ष के बाद योग्य हो तो किसी भी पद पर नियुक्त किया जा सकता है। 9-10 11-12 13-17
